Can an executive order override a law?

How constitutional authority, congressional delegations and judicial review determine what a presidential instruction can change.

Research checked October 20, 2026.

The answer depends on the legal authority

An executive order cannot repeal an act of Congress or suspend a valid statutory requirement just because the President prefers another policy. A lawful order can have binding consequences when it uses authority the Constitution gives the President or a power Congress has delegated. The important question is whether that particular action fits the authority, including its conditions and limits.

Calling an order “the law” does not turn it into legislation. The Constitution’s Article I lawmaking process and Article II executive responsibilities remain different sources of power. A President can ask Congress to change a statute, veto legislation or use an existing delegation; signing a new executive-order number is not another way to repeal a statute.

Using a statutory power is different from changing the statute

Congress can authorize the President or an agency to make choices within a legal framework. An order may select among those choices, direct a lawful review or delegate a function where delegation is permitted. It must still respect the scope, findings, procedure and funding requirements of the relevant law.

For example, 3 U.S.C. 301 permits specified presidential statutory functions to be delegated to department or agency heads and qualifying Senate-confirmed officers. It requires a written, published designation and preserves presidential responsibility. That delegation provision does not create a new substantive power over a subject Congress never authorized.

Three cases show different kinds of limits

Read the holding and its constitutional or statutory setting
Case and dateWhat the Court decidedWhy the distinction matters
Youngstown Sheet & Tube Co. v. Sawyer — June 2, 1952The President lacked authority to seize the steel mills in the circumstances presented. The Court’s holding rejected the seizure. Justice Jackson’s familiar three-category framework appeared in his concurrence; it was not the text of the majority opinion.
Learning Resources v. Trump — February 20, 2026IEEPA did not authorize the President to impose tariffs. The decision interpreted a particular delegation. It did not erase tariffs lawfully imposed under a different statute.
Zivotofsky v. Kerry — June 8, 2015Congress could not require the challenged passport designation contrary to the President’s exclusive recognition power. The Court identified a specific exclusive constitutional power and an unconstitutional statutory intrusion. It did not give presidents a general license to disregard legislation.

These cases prevent two opposite shortcuts: an order is not lawful simply because it cites Article II, and a dispute between a statute and presidential action cannot always be resolved without examining the constitutional allocation of the particular power. The Supreme Court guide separates merits holdings from emergency orders and remedies.

An order and an agency regulation have separate histories

An instruction to change a rule is not itself the completed rulemaking. 5 U.S.C. 553 generally requires notice and an opportunity for public comment for covered agency rulemaking, while specifying exceptions. The agency must identify which legal procedure applies; a presidential instruction does not silently remove the statute’s requirements.

The same point matters after revocation. Cancelling an executive order may leave a regulation, contract, adjudication or completed payment requiring its own legal treatment. Conversely, a rule can be unlawful even when the order directing the agency remains formally unrevoked. Read the later agency record and the court’s actual relief.

A contractor example: the executive policy and the statute

EO 13465 amended federal procurement policy to require a designated electronic employment-verification system for covered contractor work. Its signed text expressly preserved the Immigration and Nationality Act’s antidiscrimination obligations. The order used procurement authority; it did not authorize employers to ignore the separate employment laws.

The distinction also appears when an executive policy ends. After the January 2025 revocation of EO 11246, the Labor Department’s January 23 announcement identified Section 503 and VEVRAA obligations as statutory and still in effect. Later regulations and enforcement instructions have their own dates. The end of the earlier executive order was not repeal of those acts of Congress.

How a legal limit can be enforced

A bill, complaint or public objection does not automatically stop an order. Congress must complete the constitutional enactment process for legislation to change the governing law. A court case needs jurisdiction, a proper plaintiff and an available claim; any injunction or judgment has its own scope and procedural posture.

The Administrative Procedure Act provides review of qualifying agency action under 5 U.S.C. 706, subject to the Act’s other requirements. In Franklin v. Massachusetts (1992), the Supreme Court held that the President is not an agency under the APA. That does not make every implementing agency decision immune from review or dispose of every constitutional claim.

Common questions

Can an order change the Constitution?

A presidential directive cannot substitute for the constitutional amendment process. Article V establishes that process; Article II does not let a President revise the Constitution by signature.

Can Congress change an executive policy?

Congress can legislate within its constitutional authority, including changing delegations and funding. A proposed bill is not an enacted change, and a presidential veto triggers the Constitution’s separate override requirements.

Does a court ruling invalidate every similar order?

The judgment controls the dispute and the holding supplies the relevant legal rule. Applying it to another instrument requires attention to its authority, facts and challenged provision; similarity in a headline is insufficient.
