Do executive orders expire?

How to distinguish a sunset, a completed assignment, a continuing rescission and the end of one provision in a larger order.

Research checked October 20, 2026.

There is no single expiration rule for all orders

Some executive orders state a final date. Others create continuing instructions, end when a specified event occurs or change another instrument without introducing an independent ongoing program. A change of President does not by itself cancel every earlier order. Start with the operative clauses and then read later amendments, statutory changes and court orders.

The Justice Department’s Office of Legal Counsel explained in its January 29, 2000 opinion that presidential directives generally remain effective across administrations unless their terms or subsequent presidential action provide otherwise. That executive-branch interpretation does not excuse compliance with later law or establish that a temporary assignment continues after its own endpoint.

Different provisions use different clocks

Questions to ask before calling an order expired
Type of provisionWhat to look forExample
A one-day instructionThe exact day and exceptions; later payroll consequences do not create another holiday.EO 13453 closed covered executive offices on December 24, 2007, with essential-work exceptions.
A report deadlineThe report obligation, any extension and actual submission; a deadline is not necessarily the whole order’s sunset.EO 13414 revised one identity-theft plan deadline, with express discretion for a practicable later date.
A temporary bodyA fixed sunset or a termination event, plus any lawful continuation.EO 13452 terminated its Amtrak board when the report was submitted.
A continuing contingencyThe triggering event and statutory eligibility rather than an annual expiry assumption.EO 13461 sets an HHS succession sequence for a vacancy or inability.
A mixed instrumentWhich sections ended and which independent legal changes survive.EO 13446 combined committee continuances with a charter rewrite and a separate revocation.

The order’s title is not enough. “Amendment” might describe a new sunset, a lasting textual change or a single fulfilled assignment. “Termination” may describe a continuing revocation rather than an instrument that itself expires.

A deadline can be missed or fulfilled without ending everything

EO 13414 required a coordinated identity-theft plan by February 9, 2007 or as soon as practicable thereafter as its chair and co-chair determined. The Attorney General’s April 23 transcript records submission on April 11. The deadline-only amendment completed its function; this does not establish that the parent task force or every recommendation ended on April 11.

Where an order has continuing duties, the passage of one reporting date does not erase them without supporting language. It is equally unsafe to treat the deadline as proof of performance: locate the delivered report, agency record or other evidence of what actually happened.

Check the exact continuation and termination record

EO 13436 moved a clearance-reform report date to April 1, 2008 and the parent framework’s endpoint to July 1, 2008. EO 13467 of June 30, 2008 expressly revoked that parent before the amended sunset arrived. The original deadline, later extension and final revocation were three distinct parts of the history.

A national emergency has another statutory clock. Under 50 U.S.C. 1622(d), a timely continuation notice must be published and transmitted to Congress during the ninety days before the anniversary for the emergency to continue beyond it. That anniversary rule concerns the emergency; it does not mean every executive order expires one year after signature. The National Emergencies Act guide follows the notices and separate underlying powers.

A later order may replace only part of the earlier one

EO 13511 expressly superseded EO 13446’s first two sections effective September 30, 2009. Those sections concerned a two-year committee continuation and sponsor functions. The same 2007 instrument separately rewrote the intellectual-disabilities committee charter and revoked the completed tax-reform panel charter. Replacing the continuation did not state that every other provision was revoked.

This is why the page’s answer may be “Partly.” To assess a mixed order, identify the ended provisions and the surviving independent provision by name. A later committee renewal establishes continued charter authority for its own term; it does not prove that the committee actually held a meeting or submitted a report.

An ended program and its revoking order are different

EO 13497 revoked the regulatory-planning amendments in EO 13422 and EO 13258. The fact that revocation happened in January 2009 does not make the revoking instrument expire as soon as that legal change occurred. The earlier amendment remains revoked unless later operative authority restores or replaces it.

The successor history must be read literally. EO 13442 was expressly revoked by EO 13753 in 2016. EO 14135 revoked the 2016 successor on January 3, 2025; EO 14148 then revoked EO 14135 on January 20. Neither 2025 instrument expressly restored EO 13442. Revocation of a revoker alone is not evidence that this older DHS succession list became operative again.

Common questions

Does an order end when the President leaves office?

A change in administration alone supplies no universal sunset. The order’s terms, later presidential documents and governing law determine whether its instructions continue.

Does a final report end the order?

Only where that is the relevant completion or termination rule. Board 242’s charter expressly ended the board upon reporting, while other instruments include duties beyond a report. Read the specific clause rather than applying the board’s rule to every order.

Does an injunction mean the order expired?

An injunction limits conduct under its terms; expiration is a different source of legal change. The scope can change on appeal or through a stay, so consult the operative judgment and docket.

Can past actions still matter after the order ends?

Contracts, accrued liabilities, payments, agency rules and pending proceedings may have their own governing provisions or savings clauses. Their consequences cannot be resolved solely by the original order’s status label.
