Reading the operative provisions of Executive Order 14374
EO 14374 establishes a second emergency board under the Railway Labor Act to address unresolved Long Island Rail Road labor disputes after the earlier board process. The new board is tasked with investigating the dispute and making recommendations. The Federal Register text of EO 14374 creates that additional step; it does not itself impose a final wage or work-rule settlement.
The Railway Labor Act uses mediation and emergency-board procedures to prevent abrupt interruptions to rail service. A board investigates, hears the parties and reports recommended terms, but the recommendations are not automatically a binding collective-bargaining agreement. The parties may accept, reject or continue negotiations under the statute’s procedures. The law also provides a period for settlement efforts before certain self-help actions may occur.
EO 14374 follows EO 14349 and the first board’s work. Readers should distinguish the first report, the second board’s recommendations, subsequent bargaining and any later executive or judicial action. A board’s appointment demonstrates that the statutory process continued; it does not show that the parties resolved the dispute. The current status should be checked against the later Federal Register record and the actual agreement or labor actions.
