Executive Order 13236: Waiver of Dual Compensation Provisions of the Central Intelligence Agency Retirement Act of 1964
President: George W. Bush
Allowed the CIA Director to waive retirement-annuity reductions for a retiree temporarily re-employed during a life-or-property emergency or other unusual circumstances, without allowing new retirement credit for that service.
Status: In effect.
Is Executive Order 13236 still in effect? Yes. Active authority; recodified statute and executive-order note remain current.
What does Executive Order 13236 do?
The order assigned these duties: CIA Director — Determine temporary re-employment meets the statutory test; CIA Director — Waive reductions and delegate authority where appropriate.
Checked the waiver against the CIA retirement statute and its current codification. Preserved the temporary-employment condition, Director’s discretion, and the rule that the service earns no additional retirement credit.
Before and after
Before the order
CIA retirement law generally reduced annuities when a retired participant was re-employed by the federal government.
After the order
The order supplied the waiver contemplated by the CIA Retirement Act. The statute was later editorially recodified in title 50, and the current U.S. Code continues to print EO 13236. Intelligence reorganization transferred the relevant CIA role from the former DCI structure to the CIA Director.
