Executive Order 12967: Establishing an Emergency Board To Investigate Disputes Between Metro North Commuter Railroad and Its Employees Represented by Certain Labor Organizations

President: Bill Clinton

Created a second emergency board to investigate unresolved Metro-North commuter-rail labor disputes and choose between the parties’ final offers.

Status: Completed/expired. Is Executive Order 12967 still in effect? No. Executive Order 12967 is completed or expired. See Federal Register record.

What does Executive Order 12967 do?

EO 12967 established Presidential Emergency Board 227 under the Railway Labor Act after earlier mediation and Emergency Board 226 did not settle every Metro-North dispute. The new three-member board examined the remaining issues and, under the special statutory process, selected the more reasonable final offer issue by issue. It submitted its report on September 29, 1995; the temporary board closed and the disputes were subsequently settled.

Administration position: The order imposed a temporary fact-finding and offer-selection process to reduce the risk of commuter disruption. It did not establish permanent national rail labor terms.
