Executive Order 13516: Amending Executive Order 13462

President: Barack Obama

Revised membership information access and criminal-law referral duties for presidential intelligence advisory and oversight boards.

Status: In effect. Is Executive Order 13516 still in effect? Yes. Executive Order 13516 remains an unrevoked amendment to Executive Order 13462. Its board-membership, criminal-referral and information-access changes remain part of the President’s Intelligence Advisory Board and Intelligence Oversight Board framework; the Federal Register disposition table records a signing-date correction, not a revocation. Sources: Current Federal Register executive order disposition table: 2009; Executive Order 13516: signed Federal Register text; Official correction to Executive Order 13516, November 5, 2009.

What does Executive Order 13516 do?

EO 13516 amended EO 13462 by setting a maximum of 16 outside PIAB members, allowing a chair or co-chairs, requiring the Intelligence Oversight Board to forward possible federal crimes to the Attorney General and updating intelligence definitions and classified-information safeguards.

Later evidence reviewed September 23, 2026: Presidents appointed new members and leadership. Federal Register — 2024 official citation. The later appointment record shows subsequent use of the council; it does not prove every initial recommendation was adopted.

Administration position: The boards advise and report to the President; they do not replace inspectors general, Congress, courts or the Attorney General.
