President: Barack Obama

Assigned presidential responsibilities in the 2015 customs and trade-enforcement law to USTR and executive agencies.

Status: In effect. Is Executive Order 13733 still in effect? Yes. Executive Order 13733 remains the unrevoked delegation of presidential functions under the Trade Facilitation and Trade Enforcement Act of 2015. The Federal Register disposition table identifies no revocation; the delegated functions remain subject to the underlying statute and applicable law. Sources: Office of the Federal Register: current 2016 executive order disposition table; Executive Order 13733: signed text.

What does Executive Order 13733 do?

EO 13733 delegated numerous functions under the Trade Facilitation and Trade Enforcement Act of 2015. The assignments cover customs enforcement, evasion, forced labor, currency and trade monitoring, intellectual property, import safety and reports to Congress. Because much of the statute remains permanent, the delegation continues where current law assigns a function to the President, subject to later amendments and agency reorganizations.

Administration position: The order assigns who performs statutory duties; it does not expand the substantive powers or penalties Congress provided.
