Reading the operative provisions of Executive Order 14349
EO 14349 established an emergency board under the Railway Labor Act to investigate a dispute between the Long Island Rail Road and represented employees. The board’s task was to hear the parties, examine the dispute and issue a report with recommendations. The Federal Register text of EO 14349 creates the board; it does not itself impose a final contract settlement.
The Railway Labor Act uses a staged process to reduce the risk of service interruptions in rail transportation. An emergency board investigates and recommends terms, but its report is not automatically binding on either side. After the report, the parties may negotiate, accept proposals or proceed through additional statutory steps. The law also establishes periods during which strikes or lockouts may be restricted, giving time for bargaining and possible mediation.
A later EO 14374 cited on this page is part of the subsequent labor-dispute record and should be read separately from the initial board appointment. Board recommendations, party responses and any later presidential action each have different legal effects. To understand the outcome, check the report, collective-bargaining agreement, subsequent executive order and service status. The order’s establishment of an emergency board was one procedural step, not proof that the dispute was resolved.
