Executive Order 13322: Adjustments of Certain Rates of Pay
President: George W. Bush
Set an initial 1.5% General Schedule base adjustment for January 2004, with roughly 0.5% of payroll for locality changes; EO 13332 later superseded it.
Status: Superseded. Is Executive Order 13322 still in effect? No. Executive Order 13322 was superseded. See Executive Order 13332: Further Adjustment of Certain Rates of Pay.
What does Executive Order 13322 do?
Signed on December 30, 2003 and published on January 2, 2004, EO 13322 set 2004 pay schedules for the General Schedule, Foreign Service, some Veterans Health Administration staff and other listed positions. OPM said the initial across-the-board base adjustment was 1.5%, with an approximately 0.5%-of-payroll locality component—about a 2.0% overall average, not an identical raise for each employee. Congress then enacted the Consolidated Appropriations Act, 2004. EO 13332 superseded this order on March 3 and set a retroactive higher 2004 schedule.
Before and after
Before the order
The 2003 pay schedules were the operative prior-year baseline. The President’s August 2003 alternative plan proposed smaller 2004 adjustments than the statutory formula.
After the order
EO 13322 initially implemented a 1.5% statutory-system base increase and updated locality schedules for January 2004; OPM described roughly 0.5% of GS payroll for locality changes.
Following the January 23, 2004 appropriations act, EO 13332 superseded EO 13322 and applied a 2.7% base increase and a 4.1% overall average retroactively to the first applicable pay period in January.

Legal and source detail
How it works legally
The order used 5 U.S.C. 5303(b) for statutory pay systems and 5 U.S.C. 5304 for locality payments, alongside other statutes for listed schedules. Section 8 of EO 13332 expressly superseded it. A 1.5% base change plus a locality allocation expressed as a percentage of payroll is not a guaranteed 2.0% change to every individual salary.
