What does Executive Order 13332 do?
EO 13332 was signed on March 3, 2004 and published on March 8, after Congress enacted the Consolidated Appropriations Act, 2004. It replaced the initial 2004 pay schedules in EO 13322 with a 2.7% across-the-board increase in statutory basic pay and updated locality payments. OPM reported a 4.1% overall average compared with 2003 pay, not a uniform individual raise. The order made civilian schedules effective on the first day of the first applicable pay period beginning on or after January 1, 2004, while its uniformed-service schedule took effect on January 1. EO 13368 later superseded the 2004 order for 2005 schedules.
Before and after
Before the order
EO 13322 had initially put a 1.5% base increase and smaller locality allocations into the January 2004 schedules. Congress enacted Public Law 108-199 on January 23.
After the order
EO 13332 expressly superseded EO 13322 and issued replacement schedules. OPM implemented a 2.7% base increase and locality allocations totalling approximately 1.4% of payroll, producing a 4.1% overall average.
For covered civilian schedules, the order applied from the first applicable pay period beginning on or after January 1, 2004; individual results varied by area, grade and pay cap. EO 13368 later set the next annual schedules.

Legal and source detail
How it works legally
Section 1 cites 5 U.S.C. 5303(a) for statutory pay systems; §5 cites 5 U.S.C. 5304 and section 640(a) of Public Law 108-199 for locality payments. Section 7 states the effective dates and §8 expressly supersedes EO 13322. The new schedules do not make every employee’s individual percentage 4.1%.
