Executive Order 12867: Termination of Emergency Authority for Certain Export Controls
President: Bill Clinton
Revoked EO 12730 and rescinded its export-control emergency after Congress extended the Export Administration Act, while preserving existing controls and liabilities.
Status: Completed/expired. Is Executive Order 12867 still in effect? No. Executive Order 12867 is completed or expired. See Federal Register record.
What does Executive Order 12867 do?
EO 12867 ended the emergency arrangement that had continued export controls under IEEPA while the Export Administration Act was lapsed. Congress had extended the Act in March 1993, so the order revoked EO 12730 and rescinded that emergency while preserving existing controls, licenses and prior liabilities. The Act lapsed again in August 1994; EO 12924 then declared a new emergency and continued export-control regulations. That later action did not undo the 1993 termination or revive EO 12730.
Before and after
Before the order
EO 12730 used emergency authority to continue export controls during a lapse in the Export Administration Act.
After the order

Legal and source detail
How it works legally
The order ended one emergency basis without canceling the preserved export-control rules or prior liabilities. It expressly left other delegations and authorities intact. Modern export-control requirements must be determined from current statutes, regulations and presidential authorities.
