Executive Order 13745: Delegation of Function to the Director of the Office of Personnel Management

President: Barack Obama

Let the OPM Director activate emergency leave-sharing programs without a separate presidential direction each time.

Status: In effect. Is Executive Order 13745 still in effect? Yes. Executive Order 13745 remains an unrevoked delegation authorizing the OPM Director, in consultation with OMB, to establish emergency leave transfer programs under 5 U.S.C. 6391. The Federal Register identifies no revocation; an individual disaster program's closure does not terminate this standing delegation. What does Executive Order 13745 do?

EO 13745 delegated the President’s function under 5 USC 6391 to the OPM Director. After consulting OMB and notifying the President, OPM may establish a special program allowing federal employees to donate annual leave for colleagues adversely affected by a major disaster or emergency. The delegation remains unrevoked and supports faster activation when qualifying events occur.

Administration position: The delegation does not automatically create a program for every emergency or guarantee leave to every affected employee; OPM must activate it and eligibility rules apply.
