Executive Order 13868: Promoting Energy Infrastructure and Economic Growth
President: Donald J. Trump
Directed reviews of water-quality certification, LNG safety rules and energy rights-of-way to speed infrastructure decisions.
Status: Revoked. Is Executive Order 13868 still in effect? No. Executive Order 13868 was revoked. See Federal Register record. EO 13990 revoked this order.
What does Executive Order 13868 do?
EO 13868 assigned several energy-infrastructure reviews. EPA was to consult states and tribes on Clean Water Act section 401 certification rules and guidance; Transportation was to update liquefied-natural-gas facility safety rules through rulemaking. Interior, Agriculture and Commerce were to develop a common approach to renewing energy rights-of-way, while other agencies prepared reports on transport barriers. Each change required the applicable statutory or rulemaking process rather than taking effect solely by this order.
Evidence review, September 23, 2026: The Federal Register index records the later relationship: Revoked by EO 13990. The linked successor text should be read for the exact scope.
Before and after
Before the order
States and tribes already participated in federal permit certification under Clean Water Act section 401, and Transportation's LNG safety and federal right-of-way rules predated the review.
After the order
The order set review and reporting duties; any regulation change depended on subsequent agency process.
EO 13990 later revoked EO 13868; subsequent regulations have their own legal history.
