Executive Order 13873: Securing the Information and Communications Technology and Services Supply Chain

President: Donald J. Trump

EO 13873 declared a national emergency over foreign-adversary risks in information and communications technology and services transactions.

Status: In effect. Is Executive Order 13873 still in effect? Yes. Executive Order 13873 remains in effect. See Federal Register record.

What does Executive Order 13873 do?

It authorized the Commerce Secretary to review covered acquisitions and prohibit or mitigate transactions meeting the order’s risk tests. It did not itself ban every foreign technology product. EO 14117 later expanded the emergency to cover specified sensitive data risks, and a May 2026 presidential notice continued the emergency for another year.

Evidence review, September 23, 2026: The Federal Register index records the later relationship: Amended by EO 14117. The linked successor text should be read for the exact scope.

Administration position: The order supplies a transaction-review framework under IEEPA and the National Emergencies Act. Later rules and individual determinations control particular transactions. EO 14117 expanded the national emergency rather than revoking EO 13873.
