Executive Order 13303: Protecting the Development Fund for Iraq and Certain Other Property in Which Iraq Has an Interest
President: George W. Bush
Protected the Development Fund for Iraq and specified Iraqi petroleum proceeds from attachment and other judicial process under the declared stabilization emergency.
Status: In effect. Is Executive Order 13303 still in effect? Yes. Executive Order 13303 remains in effect. See Federal Register record.
What does Executive Order 13303 do?
Section 1 barred attachment, judgments, liens and other judicial process against the fund and specified Iraqi petroleum interests unless licensed or otherwise authorized. Treasury could issue implementing rules in consultation with State and Defense.
Checked the Development Fund for Iraq and covered property provisions against EO 13350 and the latest emergency continuation. Continuing the underlying emergency does not establish that every asset-protection provision is unchanged.
Before and after
Before the order
The 2003 Iraq reconstruction depended on protecting designated funds and petroleum proceeds from competing claims while a new Iraqi administration was being established.
After the order
The May 2026 presidential notice continued the national emergency originally declared in EO 13303, as modified by later orders.
The notice continues the emergency and cites later changes to its scope; it does not prove every original asset protection provision still operates in identical form.
