Executive Order 13349: Amending Executive Order 13226 To Designate the President's Council of Advisors on Science and Technology To Serve as the National Nanotechnology Advisory Panel

President: George W. Bush

Amended EO 13226 to designate PCAST as the advisory panel required by the nanotechnology research statute.

Status: In effect. Is Executive Order 13349 still in effect? Yes. Executive Order 13349 remains in effect. See Federal Register record.

What does Executive Order 13349 do?

EO 13349 added section 2(c) to EO 13226, assigning PCAST the National Nanotechnology Advisory Panel role under section 4 of the 2003 Act. The National Nanotechnology Initiative’s supplement to the President’s FY2025 budget says PCAST reviewed the initiative in 2023 in its capacity as that advisory panel and summarizes three recommendations. The review is advice, not enactment of the recommended changes.

Administration position: The order designated an existing presidential science council to fulfill a statutory nanotechnology advisory role.

Before and after

Before the order

EO 13226 established the President’s Council of Advisors on Science and Technology; the 2003 nanotechnology statute required a national advisory panel.

After the order

EO 13349 added section 2(c) to EO 13226, assigning PCAST the National Nanotechnology Advisory Panel role under section 4 of the 2003 Act.

What did the signed order change?

EO 13226 established the President’s Council of Advisors on Science and Technology; the 2003 nanotechnology statute required a national advisory panel. EO 13349 added section 2(c) to EO 13226, assigning PCAST the National Nanotechnology Advisory Panel role under section 4 of the 2003 Act.

What happened later?

National Nanotechnology Initiative — FY2025 budget supplement documents this later development: The National Nanotechnology Initiative’s supplement to the President’s FY2025 budget says PCAST reviewed the initiative in 2023 in its capacity as that advisory panel and summarizes three recommendations. The review is advice, not enactment of the recommended changes.

What does that evidence establish?

The signed order amends EO 13226, not EO 13326 (which concerned the 2004 space-exploration commission). The panel role derives from the 21st Century Nanotechnology Research and Development Act. A PCAST review is advisory and does not itself fund a research program. The panel’s recommendations do not establish that Congress or agencies adopted each proposal. The signed order controls its original terms.
