Executive Order 13084: Consultation and Coordination With Indian Tribal Governments

President: Bill Clinton

Required agencies to consult tribal governments on policies with significant tribal effects and to limit unfunded regulatory burdens.

Status: Revoked.

Is Executive Order 13084 still in effect? No. Revoked and superseded by EO 13175 effective January 6, 2001.

What does Executive Order 13084 do?

EO 13084 set government-to-government consultation and regulatory principles for federal policies that significantly or uniquely affected tribal communities. It addressed consultation, direct compliance costs, waivers and flexible policy approaches. EO 13175 replaced it with a revised framework for policies having tribal implications and expressly revoked EO 13084 when the replacement took effect.

Administration position: The order governed how executive agencies developed policy; it did not diminish tribal sovereignty or create an independently enforceable private right.
