Executive Order 13083: Federalism

President: Bill Clinton

Set 1998 federalism review and consultation criteria for agencies; it was suspended and then replaced.

Status: Revoked. Is Executive Order 13083 still in effect? No. Executive Order 13083 was revoked. See Executive Order 13132: Federalism, Federal Register record.

What does Executive Order 13083 do?

EO 13083 directed executive agencies to assess federalism effects when developing policies, consult state and local officials, and consider flexibility in federal program waivers. It also revoked two earlier federalism orders. EO 13095 suspended EO 13083 in August 1998, before its stated 90-day effective date, and EO 13132 revoked and replaced it in August 1999. Its 1998 procedures should not be presented as current requirements.

Administration position: The order’s constitutional policy statements were presidential guidance for agencies, not an independent grant of federal power over states.
