Executive Order 13813: Promoting Healthcare Choice and Competition Across the United States

President: Donald J. Trump

Directed agencies to consider association health plans, short-term insurance and health reimbursement arrangements.

Status: Revoked — by EO 14009.

Is Executive Order 13813 still in effect? No. EO 14009 revoked it.

What does Executive Order 13813 do?

EO 13813 directed Labor, Treasury and Health and Human Services to consider changes to association health plans, short-term limited-duration insurance and health reimbursement arrangements. These were instructions to examine and propose policy, not direct amendments to health-insurance contracts or the Affordable Care Act. Agencies later issued separate rules, whose legal histories vary. EO 14009 expressly revoked the 2017 directive in 2021; later health coverage rules must be read on their own terms.

Administration position: Assertions about costs and competition were administration policy claims; the order did not establish individual coverage effects.
