What this topic covers
Immigration orders address border operations, entry screening, refugee admissions, visa processing, interior enforcement, naturalization, and the federal government’s interpretation of citizenship law. They often assign work to the Departments of Homeland Security, State, Justice, and Labor. An order can direct executive officials to use authority in the Immigration and Nationality Act, but cannot by itself amend that statute or settle a constitutional question for the courts. The page’s linked guides distinguish a signed directive from agency rules, memoranda, and judicial orders.
Clinton used orders on naturalization for service members and on border cooperation; George W. Bush continued military naturalization and changed responsibilities for migrant interdiction. Obama’s EO 13597 set visa-processing goals and created an interagency travel task force. The Deferred Action for Childhood Arrivals policy, however, began in a 2012 Department of Homeland Security memorandum, not an executive order. That distinction matters when evaluating later actions: a policy created by an agency memorandum is not automatically an executive order simply because a President later changes the surrounding enforcement framework.
Trump’s first term issued EO 13769 and EO 13780, the first two versions of the travel-ban policy sequence, as well as EO 13768 on interior immigration enforcement. Biden’s EO 13993 revoked EO 13768 and set new enforcement priorities; EO 14010 addressed regional migration, and EO 14012 directed a review of the legal immigration system. These broader enforcement orders touched the context in which DACA operated, but neither the DACA creation nor its rescission was itself an executive order. For the travel-ban litigation, Trump v. Hawaii reviewed a later proclamation in that policy sequence, not EO 13769 as originally signed.
Trump’s second term issued EO 14159 on immigration enforcement, EO 14161 on foreign-terrorist screening, and EO 14160 on birthright citizenship. EO 14160 sought to deny recognition of citizenship to two groups of children born in the United States based on their parents’ immigration status. In Trump v. CASA (2025), the Supreme Court addressed the scope of universal injunctions without deciding the citizenship merits. In June 2026, Trump v. Barbara decided the merits and held that the parent-status exclusions described in EO 14160 violate the Citizenship Clause. The order is not in effect; see the site’s birthright-citizenship explainer for the signed text, the two distinct decisions, and later 2026 orders.
EO 12939 (1994) expedited naturalization for eligible noncitizens serving on active duty during the Persian Gulf conflict.
EO 13269 (2002) extended expedited naturalization eligibility to qualifying military service during the war on terrorism.
EO 13597 (2012) set visa-processing goals and created a federal travel-promotion task force.
EO 13769 and EO 13780 (2017) are the two initial travel-ban orders and led to major litigation, including Trump v. Hawaii.
EO 13768 (2017) addressed interior enforcement; EO 13993 revoked it and set Biden-era enforcement priorities. DACA itself originated in a DHS memorandum, not an EO.
EO 14010 and EO 14012 (2021) set a regional migration framework and reviewed legal immigration pathways.
EO 14160 (2025) prompted the birthright-citizenship dispute decided on the merits in 2026; read the full explainer for the court rulings and later orders.
